Below are sentencing guidelines for robbery, aggravated robbery and armed robbery in Arizona. The sentencing and penalties may be reduced or increased in severity based on mitigating and aggravating factors presented on behalf of the prosecution and criminal defense attorneys in the case.

I. Robbery Penalties and Sentencing (over 18 years of age) :

Robbery under ARS § 13.1902 charged as a class 4 felony in Arizona, if convicted, the following penalties apply:

  • First Offense – 1 years to 3.75 years prison; $750 to $150,000 fines; fees; assessments; costs; restitution;
  • Second Offense – 2.25 years to 7.5 years prison; $750 to $150,000 fines; fees; assessments; costs; restitution; with few exceptions not eligible for probation;
  • Third Offense – 6 years to 15 years prison; ; $750 to $150,000 fines; fees; assessments; costs; restitution; with few exceptions not eligible for probation.

II. Aggravated Robbery Penalties and Sentencing (over 18 years of age):

Aggravated Robbery under ARS § 13.1903 charged as a class 3 felony in Arizona, if convicted, the following penalties apply:

  • First offense – 2 years to 8.75 years prison; $750 to $150,000 fines; fees; assessments; costs; restitution
  • Second offense – 2.25 years to 7.5 years prison; $750 to $150,000 fines; fees; assessments costs; restitution
  • Third offense – 6 years to 15 years prison; $750 to- $150,000 fines; fees; assessments costs; restitution.

Person (s) sentenced pursuant to II above with few exceptions, are not eligible for a suspended sentence; probation; pardon or release from confinement. Fines apply per person.

III. Armed Robbery Penalties - Dangerous Offenses (over 18 years of age)

Armed Robbery under ARS § 13.1904 is considered a “Dangerous Offense”. Dangerous Offense Sentencing and Penalties are cited under ARS § 13.704 as follows:

  • First Offense – 7 years to 21 years prison; $750 to $150,000 fines; fees; assessments; costs; restitution;
  • Second Offense – 14 years to 28 years prison; $750 to $150,000 fines; fees; assessments; costs; restitution;
  • Third Charge with two or more prior Dangerous Offense Convictions – 21 years to 35 years; $750 to $150,000 fines; fees; assessments; costs; restitution;
  • Two or more Dangerous Felony Offenses not committed in the same incident, may be consolidated for trial purposes; or that are not historical prior felony convictions- 10.5 years to 26.5 years prison; $750 to $150,000 fines; fees; assessments; costs; restitution;
  • Three or more Dangerous Felony Offenses not committed in the same incident, may be consolidated for trial purposes; or that are not historical prior felony convictions- 15.5 years to 35 years prison; $750 to $150,000 fines; fees; assessments; costs; restitution.

Person (s) sentenced pursuant to III above with few exceptions, are not eligible for a suspended sentence; probation; pardon or release from confinement.

Fines for Dangerous and repeat “enterprises” may be ordered up to 1 million dollars.
